All personal information maintained by the National Museum of Korea are is collected, possessed, and processed pursuant to relevant regulations or to consent from the information owners.

The Act for Protection of Personal Information by Public Agencies provides the general standards about the handling of such personal information. NMK shall manage such information which is collected, possessed, and processed in legitimate and proper ways under by adhering to regulations for the purpose of appropriate execution of public affairs and protection of people’s rights.

Pursuant to relevant regulations, members will be honored to have the right to read, right to and request for correction, etc. for such personal information that NMK possesses. Members are entitled to file administrative judgment subsequent to Administrative Judgment Act for any infringement on of their own legal rights.

Limitation on Use and Provision of Personal Information

Different from general administrative information, NMK’s personal information is strictly limited on use and provision. Article 10 (Limitation on Use and Provision) of Act for Protection of Personal Information by Public Agencies provides as follows in relation to this;:

1. When using internally or providing to other agencies pursuant to other regulations
2. In the event of one of followings
   • When agreed by information subjects, or when providing to information subjects
   • When there are reasonable grounds to use such processed information in order to execute its competent works designated in other regulations.
   • When providing to foreign governments or international institutions for execution of international treaties.
   • When providing for the purpose of statistics, academic studies, etc. in the form in which a specific person is unidentifiable
   • When providing information is apparently considered to be beneficial to such information subjects while they, or their legal representatives, are not under proper situation for expressing their opinions or addresses are incorrect.
   • When necessary for investigation of crimes and prosecuting case.
   • When necessary for holding trials in courts
   • Under special cases in which Presidential Ordinances stipulate

Presently, NMK routinely provides the following personal information to other agencies under the above regulations and other individual regulations.

NMK shall make efforts to prevent any inappropriate use by strict observation or of relevant regulations in use and provision of personal information.

Request for Reading and Correction of Personal Information Files

Members have the right to access to their own information pursuant to Act for Protection of Personal Information by Public Agencies and other relevant regulations.

2. Process to request for access (In case under Act for Protection of Personal Information by Public Agencies)
   • Request: Requesting Person (Information Subject) / Request by Form / Head of Possessing Agency / Decision to be Sent within 7 days / Within 15 days after Request / Access / Result of Request for Correction to be sent within 15 days / Extension to be allowed for 1 time
3. Access may be restricted at any event of the followings pursuant to Article 13 of the Act.
   1. When competent works are significantly bothered at any event of the following cases.
      • If it is concerned with taxation
      • If it is related to evaluation, admission of students, qualification in the recruit recruitment process, assessment of compensation by schools under Education Law
      • If inspection or investigation is needed subject to other regulations
      • If it is related to prevention of real estate speculation on lands and houses.
      • If it is related to prevention of unfair transaction of securities pursuant to Securities Exchange Act
   2. When individual lives or bodies are liable to be damaged, or properties or other profits are expected to be unfairly damaged. Each information subject is entitled to request for correction in the case of the following matters after access.

Relief from Infringement of Rights

Any person, who is damaged to its has their rights or interests damaged by treatment or non-performance of a head of a public agency against its request according to Clause 1 of Article 12 (Access to processed information), and Clause 1 of Article 14 (Correction of processed information) of Act for Protection of Personal Information by Public Agencies, is entitled to file administrative judgment subsequent to Administrative Judgment Act
